Introduction
Paprclip, Inc., (“Company” or “we”) respects your privacy and is committed to protecting it through compliance with this policy. This policy describes:
● The types of information we may collect or that you may provide when you download, install, create an account on, access, or use the application (the “App”).
● Our practices for collecting, using, maintaining, protecting, and disclosing that information.
● The controls we have in place to manage the information you share with us.
This policy applies only to information we collect in this App, and in email, text, and other electronic communications sent through or in connection with this App, and any other related sites or services.
This policy DOES NOT apply to information that:
● We collect offline or on any other company’s apps or websites, including websites you may access through this App.
● You provide to or are collected by any third party, including other apps, websites, or content that may link to or be accessible from or through this App (see Third-Party Information Collection).
Third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, create an account, or use this App. By downloading, creating an account, or using this App, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this App after we revise this policy means you accept those changes, so please check the policy periodically for updates.
Definitions
● Company: Paprclip, Inc., located at 581 Warren Street, Apt 1L, Brooklyn, NY 11217. May also be referred to throughout this Policy as “we,” “us,” “our,” “the App.”
● Cookies: A small file placed on your device. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting, you may be unable to access certain parts of our App.
● Personal Data/Information: Any information that is identifying to an individual, either on its own or combined with other information that is traced or traceable to a certain individual, including but not limited to your full name, email address, telephone number, IP address, mailing address, and payment information.
● Posted: Any content or information that Users provide for publication or display, including on their own account, and on other accounts.
● Processing: The collection, storage, transmission, or other use of Users’ personal data/information on the App.
● Third Parties: Any person, entity, or other authority outside of Paprclip that receives personal information/data from Users but does not operate under our direct control.
● User: Any person who downloads the App, creates an account, and uses the App. May also be referred to throughout this Policy as “you.”
● User Contributions: Any information or content that Users post on their own accounts, or on another User’s account.
● Web Beacons. Pages of the App and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the App, for example, to count users who have visited those pages or opened an email and for other related app statistics, for example, recording the popularity of certain app content and verifying system and server integrity.
Age Restrictions
The App is not intended for users under 18 years of age. No one under age 18 may provide any personal information from anyone under 18. We do not knowingly collect personal information from anyone under 18. If you are under 18, do not use or provide any information on this App or through any of its features, create an account on the App, make any purchases through the Website, use any of the interactive or public comment features of the App or Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use.
If we learn we have collected or received personal information from anyone under the age of 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about someone under 18, please contact us at [hello@paprclip.com].

Information We Collect and How We Collect It
We collect information from and about users of our App:
● Directly from you when you provide it to us.
● Automatically when you use the App.
● When you visit our website.
● When information is shared by third parties.
Information You Provide to Us
When you download, create an account, or use this App, we may ask you provide information:
● By which you may be personally identified, such as your full name, postal address, email address, telephone number, age or any other relevant personal information to onboard you onto the app while remaining legally compliant (“personal data/information”).
● That is about you but individually does not identify you, such as age, gender identity, geographic location, etc.
This information includes:
● Information that you provide by filling in forms in the App. This includes information provided at the time of creating an account on the App, posting material, and requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with the App.
● Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
● Any information you wish to include on your profile, including but not limited to, a biography, your location, and a profile picture.
● Your responses to surveys that we might ask you to complete for research purposes.
● Details of transactions you carry out through the App and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the App.
● Your search queries on the App.
● Content Data: When you use the App, you can decide to share the following data:
o Photos and videos that you take (“Content”) using the App or photos that you share from your library. You can create an account without allowing us to access and collect data from your device’s camera or photo library.
o You can decide to share your location when you share Content through the App. If you choose to share your location and you are not a child, by default, your precise location – street level – is shared but you can switch it to your approximate location – city level.
o Your reactions to and comments on your friends’ Content.
● Chat Data: When you use the Paprclip chat function, we collect the messages, photos, videos, and other content that you share with your friends within the chat.
● Communications with Paprclip: When you report a concern with the App, request assistance, respond to a survey, or reach out to us for any other reason, we collect the following data:
o Your email address;
o Your telephone number;
o The content of the communication with us, including any photos, videos, or audio recordings you may have included;
o Any other information you may decide to share with us.
● You may also provide information for publication or display (“Posted”) on public areas of the App or websites you access through the App/https://www.paprclip.com/ (collectively, “User Contributions”). Your User Contributions are Posted and transmitted to others at your own risk. [Although you may set certain privacy settings for such information by [logging into your account profile/ [PRIVACY SETTINGS INSTRUCTIONS]], please be aware that no security measures are perfect or impenetrable.] Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our App, including when you download, access, or use the App, we may use automatic data collection technologies to collect certain information about your device and your browsing and usage activity and patterns, including:
● Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the App.
● Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.
● Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
● Interaction Data: Friends (Ie. number of friends, friend invitations, the friends with whom you interact with the most, friend requests).
● Inferred Information: We analyze information you provide when you create an account and the Content you post to infer information about you, such as your time zone and your interests.
● Other Apps: We receive information that allows us to bring features to you for partner applications or other service integrations (i.e., Instagram, snapchat, etc.). This will include all necessary device data, and other optional data that you may choose to share as part of the integration.
● Location Information. This App collects real-time information about the location of your device.
● Contact List Data: You can decide to grant the App access to your phone’s contact list to identify the friends in your contacts who may already have an account, or to recommend new friends for you. The App does not access your contact list without your permission. If you grant this permission and later decide to revoke it, you may change the setting in your account, and we will no longer collect or update contact information from your contact list. Any previously uploaded contact data will be deleted within a reasonable time.
If you do not want us to collect this information, do not download the App or delete it from your device.

We also may use these technologies to collect information about your activities over time and across third-party websites, apps, or other online services (behavioral tracking).
The technologies we use for automatic information collection may include:
● Cookies;
● Web Beacons;
We do not collect personal information automatically, but we may tie non-personal information collected automatically to personal information about you that we collect from other sources or that you provide to us.
Third-Party Information Collection
When you use the App or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:
● Advertisers, ad networks, and ad servers.
● Analytics companies.
● Your mobile device manufacturer.
● Your mobile service provider.
These third parties may use tracking technologies to collect information about you when you use the App. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. WE DO NOT TAKE ANY RESPONSIBILITY FOR ANY OTHER PARTNER APPLICATIONS. WE DO NOT TAKE ANY RESPONSIBILITY FOR ANY BREACHES FROM THIRD PARTY APPLICATIONS OR PARTNERS.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information, to:
● Provide you with the App and its contents, and any other information, products, or services that you request from us.
● Fulfill any other purpose for which you provide it.
● Give you notices about your account/subscription, including expiration and renewal notices.
● Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
● Notify you when App updates are available, and of changes to any products or services we offer or provide though it.
The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to:
● Estimate our audience size and usage patterns.
● Store information about your preferences for customization purposes.
● Speed up your searches.
● Recognize you when you use the App.
We use location information we collect for data analyzation purposes, to better understand our User demographics.
We may also use your information to contact you about our own and third parties’ goods and services that may be of interest to you. For more information, see Choices About How We Use and Disclose Your Information.
We may use the information we collect to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.
Data Retention and Deletion
We value your right to control your personal data and have included an account deletion option for App Users. If you decide that you no longer want to use our App, you can delete your account at any time.
Deleting your account does not automatically delete your personal information.
We retain your personal information for as long as is necessary to fulfil the purposes for which it was collected.
When information is no longer needed for any of these purposes, we delete or anonymize it in accordance with applicable law.
If you delete your account, we will delete or anonymize your account and profile data within 30 days, except where a longer retention period is required for any accounting or legal compliance purposes.
Notwithstanding the above, we may retain certain information for longer periods where necessary to:
· Comply with applicable legal or regulatory obligations (for the period required by the relevant law)
· Resolve active or reasonably anticipated disputes or legal claims (until final resolution)
· Enforce our Terms & Conditions and other agreements
· Maintain transaction history, tax records, and other business records required for accounting and legal compliance purposes (up to 7 years)
Where retention is required for one of these purposes, we retain only the minimum information necessary for that purpose and do not use it for any other purpose during the retention period.
Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction.
In addition, we may disclose personal information that we collect or you provide:
● To our subsidiaries and affiliates.
● To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
● To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Company about our App users is among the assets transferred.
● To third parties to market their products or services. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.
● To fulfill the purpose for which you provide it. For example, if you give us an email address to use the “email a friend” feature of our App, we will transmit the contents of that email and your email address to the recipients.
● For any other purpose disclosed by us when you provide the information.
● With your consent.
We may also disclose your personal information:
● To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
● To enforce our rights arising from any contracts entered into between you and us, including the Terms of Use and for billing and collection.
● If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Paprclip, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
Right to Opt Out of Sale/Sharing and Targeted Advertising
You have the right to opt out of the “sale” or “sharing” of your personal information and its use for targeted advertising. To opt out, use the “Do Not Sell or Share My Personal Information” control in Settings → Privacy. We will process requests within 15 business days and will not discriminate against you for opting out.
Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures over your information.
● Tracking Technologies. You can set your App settings to refuse all or some cookies, or to alert you when cookies are being sent. You can choose whether or not to allow the App to collect information through other tracking technologies through your device settings.
● Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device’s location through your device’s privacy settings or in the App’s settings. If you block the use of location information, some parts of the App may become inaccessible or not function properly.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Accessing and Correcting Your Personal Information
You can review and change your personal information by logging into the App and visiting your account profile page.
You may also send us an email at hello@paprclip.com to request access to, correct, or delete any personal information that you have provided to us. In the overhwelming majority most cases, we cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you delete your User Contributions from the App, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other App Users. Proper access and use of information provided on the App, including User Contributions, is governed by our terms of use, which is located at paprclip.com.

Your Rights Over Your Information
● Right to access and obtain a copy of your data: You may request access to your personal data. If you request such access, we will provide you with all the information required by law, including the purposes of the processing, the categories of data processed, the categories of recipients, the data retention periods and your rights.
● Right of rectification: You may also ask us to rectify any personal data concerning you that is inaccurate and to complete any incomplete information.
● Right to erasure/deletion: Under certain circumstances, you may request the erasure of your personal data. We may nevertheless need to retain certain limited data in an archived database, in particular if we have a legal obligation to retain such personal data or if it is necessary for the exercise or defense of legal claims.
● Right to restrict processing: In certain circumstances, you may request the limitation of the processing of your personal data, in particular when you request the rectification of your personal data.
● Right to withdraw your consent: Where the processing of your personal data is based on your consent, you may, at any time, withdraw any consent you have previously provided to us. Such withdrawal does not affect the lawfulness of processing based on consent prior to withdrawal.
● Right to object: You may object at any time to the processing of your personal data when it is used for commercial prospecting purposes or for reasons related to your particular situation.
● Right to portability: In certain cases, you may also obtain a copy of your personal data, in a commonly used and machine-readable format, to enable you to exercise your right to data portability.
Your Privacy Rights
Depending on your residency in the United States or in Canada, you may have specific statutory rights to access, delete, correct, or restrict the sale or sharing of your personal information, as well as the right to withdraw your consent at any time. By using this App, you acknowledge and agree that your data may be transferred, stored, and processed outside your home state or province in accordance with this Privacy Policy and applicable local laws.
State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the App. The information you share in public areas may be viewed by any user of the App.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App.
Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures included through the App.
Payments
When you pay for any of our services (i.e. a subscription for a premium account), your payment is processed by a third-party payment processor.
Your payment details are transmitted directly to the third-party processor. We will not and do not store your full payment information on any of our systems.
Changes to Our Privacy Policy
We may update our privacy policy from time to time. If we make material changes to how we treat our users’ personal information, it is our policy to notify you by email to the primary email address specified in your account [and/or] through a notice on the App’s home page/https://www.paprclip.com/.
The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address and/or phone number for you and for periodically visiting this privacy policy to check for any changes.

Applicable Law/Legal Jurisdiction
You expressly agree that the exclusive jurisdiction for any claim or dispute under the terms of this Policy resides in the courts located in New York, New York and you further expressly agree to submit to the personal jurisdiction of such courts for the purpose of litigating any such claim or action.
If it turns out that a particular provision in these Terms is not enforceable, that will not affect any other provision.
